Iain J. MacMillan
Senior Associate

Iain MacMillan is a Senior Associate with AGC in the firm's transactional and litigation departments, and currently serves as Deputy City Attorney for the cities of Chico, Pico Rivera, Commerce, Lynwood, Montebello, and Huntington Park. Prior to rejoining AGC, he served as the Assistant City Attorney for the City of Mission Viejo and served as lead attorney for the City of Mission Viejo's Planning Commission. In these capacities, he works daily with councilmembers, city managers, and department heads on complex municipal law issues.

On a daily basis, he advises the firm's public agency clients in all matters of general municipal law, including land use and planning, election laws, homeless issues, tax and fee matters, contract negotiations and drafting, ordinance and resolution crafting, real property transactions, conflicts of interest, Brown Act and Public Records Act compliance, and day-to-day government affairs.

Mr. MacMillan is also well-versed in the areas of local planning, land use, and environmental matters. He has worked and advised clients on countless development projects, entitlement matters, and special issues surrounding cannabis, accessory dwelling units, sober living homes and wireless telecommunication facilities.

As an experienced code enforcement attorney, Mr. MacMillan worked with city staff to first seek resolution of all matters related to municipal code violations without the need to commence litigation whenever possible. However, if compliance was not met, Mr. MacMillan counseled cities about the available administrative, civil and/or criminal remedies to secure municipal and code compliance.

Mr. MacMillan has extensive experience in criminal prosecution and public nuisance abatement. Mr. MacMillan prosecuted and/or abated public nuisance violations of cities' laws, including, but not limited to: prohibited, non-permitted, or non-compliant land uses, and unlicensed or non-compliant businesses, including massage establishments, gambling establishments, and marijuana dispensaries. Mr. MacMillan has also provided training to city officials, from investigation techniques, to report writing.
